Business Spotlight 

Chris Curran was today's spotlight.  The Arizona legislative session is progress and there are several bills on the table that affect small businesses.  Chris touched on a few...

HB2111: workers' compensation; controlled substances; alcohol - If your company has a drug testing policy then the burden of proof falls onto the employee.  If not, you the employer carry the burden of proof.  Nick Mawrenko warns members to be careful when establishing a drug testing policy or you could open a can of worms.  Your best bet is to use a random drug testing or you risk losing a lot of employees.

SB1124: uniform arbitration act - It is important to know what you are giving up when you sign an arbitration agreement.  You can fire an employee if they refuse to sign this agreement.

HB2177: health insurance premium tax credit - This is a good bill but Chris will be surprised if it passes.  Note that it only applies to companies with 2 or more employees and there are limitations.

HB2849: minimum wage - This bill proposes a minimum wage change to $7.10 with an annual increase based on the consumer price index.  Chris doesn't believe it will pass.
 
HB2823: unlawful employment practices; penalties - This bill addresses items like the I-9 form.  You need to have things in place or you could face fines in the amount of $5000.  As for the I-9 form, it was recommended that you NOT keep copies of identification used to confirm the I-9 is correct.  If they turn out to be fake, you will be liable.  All you are required to do is check-off that you "saw" the identification.

HB2099: cellular telephones; use while driving - Get ready to invest in hands-free devices.

HB2698: small business health insurance plans - Read the fine print.  Clinical trials were never paid for by insurance companies.

Andy is from a small, southern Oregon town.  It was a beautiful place to grow up.  His father is a retired dentist that now works part-time with Lisa Schnaidt, a former MABE member.  His brother works for Geiko Insurance.  Andy attended both Oregon State and the University of Oregon but he is a Duck all the way!  After graduating in 1989, Andy moved to Arizona for a change of scenery.

Andy's first job was selling cars at Berge Ford.  He had quite a career there.  It lasted 3 weeks.  His first "real" job was with System One Rent-A-Car.  He earned $275 a week doing a mandatory 59-hour work week with no overtime.  He met his wife there.  She was his boss...still is.  His next job was for a mortgage company.  He learned a lot here.  It was very helpful.  He left 11 years ago for a job with Smith Barney.

In 1999 Andy joined MABE.  He was fascinated by one of the questions that was presented...If you could trade careers with anyone in the room, who would it be?  About 60% wanted Andy's job.  But this was at a time when the markets were on fire.  Andy posed the question again and this is how members responded...

  • Gary Nelson wants to be Lisa Wolfe because he likes her husband (interesting)

  • Lisa Wolfe wants to be Dave Crissman because of his ability to reinvent his business.

  • Phil Passante wants to be Chuck Hultstrand because he admires his quite confidence and kindness.

Andy gave members some general rules of thumb when investing...

  • Don't count on anything you have no control over.

  • Plan with realistic intentions.

  • Don't stop investing.

  • Work with somebody you can trust.

What makes the markets go up?  Supply and demand.  Although, fear and greed are the most influential factors.  Markets over time should work their way higher. 

People have a tendency to chase what is working currently.  Andy likes to look at the broader picture.  Take GM for instance.  They have taken a hit because of gas prices and their large line of SUVs.  Others are currently doing better because they were one step ahead.  But GM still has cash and there stock is half the price it was.

Andy is optimistic about what will happen in the market over the next 10 years.  Instead of putting the money in their pocket when stocks aren't performing well, people are rotating their money.
